By downloading, installing, or using CalTrack ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

CalTrack is a calorie tracking application that helps users monitor their daily food intake, track nutritional information, and maintain healthy eating habits. The App provides tools for logging meals, calculating calories, and monitoring progress toward health goals.

3. Subscription Plans and Pricing

CalTrack offers the following subscription plans:

  • Weekly Subscription: €5.99 per week
  • Monthly Subscription: €17.99 per month
  • Annual Subscription: €49.99 per year (equivalent to €4 per month)

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage your subscription through your Apple App Store or Google Play Store account settings.

4. Payment and Billing

All payments are processed through the Apple App Store or Google Play Store. By subscribing, you authorize recurring charges to your chosen payment method. Prices are subject to change with notice.

Cancellation: You can cancel your subscription at any time through your device's subscription settings. Cancellation will take effect at the end of the current billing period.

Refunds: Refund policies are governed by Apple App Store and Google Play Store terms. Generally, refunds are not provided for unused portions of subscription periods.

5. User Responsibilities

You agree to:

  • Use the App in accordance with these Terms
  • Provide accurate information when using the App
  • Not use the App for any illegal or unauthorized purpose
  • Not attempt to reverse engineer or modify the App
  • Not share your subscription access with others

6. Health and Medical Disclaimer

IMPORTANT: CalTrack is designed for informational purposes only and is not intended to provide medical advice, diagnosis, or treatment. The nutritional information and calorie calculations provided by the App are estimates and may not be completely accurate.

Always consult with qualified healthcare professionals before making significant changes to your diet or exercise routine. CalTrack is not a substitute for professional medical advice.

7. Intellectual Property

The App and its content, features, and functionality are owned by CalTrack and are protected by international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the App. The Privacy Policy is incorporated into these Terms by reference.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALTRACK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11. Termination

We may terminate or suspend your access to the App at any time, with or without cause or notice. Upon termination, your right to use the App will cease immediately.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any changes by posting the new Terms in the App and updating the "Last updated" date. Your continued use of the App constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where our company is located, without regard to conflict of law principles.
